*General rules
* Articles are formulated to standardize and strengthen the construction and operation management of the State Key Laboratory (hereinafter referred to as the laboratory).
The second laboratory is an important part of the national science and technology innovation system. It is an important base for the state to organize high-level basic research and applied basic research, gather and train outstanding scientists, and carry out academic exchanges.
The third task of the laboratory is to carry out innovative research based on the national science and technology development policy, focusing on the national development strategy, focusing on the frontiers of discipline development and major scientific and technological issues of national economy, social development and national security. The goal is to obtain original innovations and independent intellectual property rights.
The fourth laboratory is a research entity built on the basis of universities, research institutes and other institutions with original innovation capabilities. Have relatively independent personnel and financial rights.
Chapter II Duties Article 5 The State implements hierarchical classification management of laboratories. The Ministry of Science and Technology (hereinafter referred to as the Ministry of Science and Technology) is the macro management department of the laboratory. Its main responsibilities are:

Article 7 The supporting unit is the specific responsible unit for the implementation of laboratory construction and operation management. The main responsibilities are:
1. Provide logistics support and funding conditions for the laboratory.
2. Responsible for recommending the laboratory director and the director of the academic committee, and appointing the deputy director of the laboratory, the deputy director and member of the academic committee.
3. Conduct an annual assessment of the laboratory and cooperate with the Ministry of Science and Technology and the competent authorities to do a good job in the evaluation of the laboratory.

Article 14 The construction of laboratories shall be based on the principle of “construction, research and opening”. During the construction of the laboratory, the supporting unit shall report the progress to the competent department on a regular basis to ensure the relative stability of the laboratory personnel. During the construction period, if the director of the laboratory is absent for more than half a year, he/she should generally adjust it in time and report it to the competent department for approval. The special circumstances should be reported to the Ministry of Science and Technology for approval.
Article 15 The period of construction of a laboratory shall generally not exceed two years. After completion, the application for acceptance shall be submitted and submitted to the Ministry of Science and Technology after the preliminary examination by the competent department, and the Ministry of Science and Technology shall approve the approval after approval.

Chapter IV Changes and Adjustments Article 17 According to the needs of national economic and social development, the development of disciplines, and the actual operation of laboratories, the Ministry of Science and Technology may adjust the layout and structure of laboratories, and reorganize, integrate, and withdraw laboratories.
Article 18 The Ministry of Science and Technology strives for effective funding channels to support the updating of laboratory equipment. After the Ministry of Science and Technology organizes the demonstration, the competent department will organize the implementation. Article 19 If the laboratory does need to change its name, change its research direction, or carry out structural adjustment or reorganization, it shall be submitted by the laboratory director to submit a written report. Chapter V Operation and Management Article 20 The laboratory shall implement the operation mechanism of “openness, mobility, unity and competition” and try to rely on the director responsibility system under the leadership of the unit.
Article 21 The director of the laboratory shall be recommended by the supporting unit, and the competent department shall be appointed to report to the Ministry of Science and Technology for the record. The director should be a high-level academic and academic leader in the field, with strong organizational management and coordination skills, generally no more than 60 years old, and a term of five years. Generally, the working hours in the laboratory are not less than eight months each year (the total unemployed time is more than 18 months), and the special circumstances must be approved by the competent department.
Article 22 The academic committee is the academic guidance institution of the laboratory. The main task is to review the objectives, tasks and research directions of the laboratory, review the major academic activities and annual work of the laboratory, and approve open research topics. Academic committee meetings are held at least once a year.
Article 23 The academic committee shall be composed of outstanding experts at home and abroad, with a maximum of 15 persons, of which the academic committee of the supporting unit shall not exceed one third of the total number of members, and the young and middle-aged academic committee members shall not be less than one third. Academic members are appointed for a term of five years, no more than seventy years old, and that more than one-third of the members should be replaced for each change.
Article 24: The laboratory shall implement the system of project management and the first-level personnel system. The research team shall consist of fixed personnel and mobile personnel. A small number of fixed personnel shall be mainly academic and academic leaders (chief experts), according to the laboratory. The disciplines established are strictly controlled by the disciplines and are openly appointed by the laboratory director. The number of other researchers is subject to the discretion of the subject and academic leaders (the chief expert) according to the needs of the research work and the actual situation of the subject. After the approved personnel are approved as the mobile director, the relevant expenses are borne by the research team. The laboratory should pay attention to stabilizing a high-level technical team.
Article 25 The laboratory shall set up open funds and open projects according to the research direction, attract outstanding scientific and technological talents at home and abroad, increase opening up, and actively carry out international and domestic cooperation and academic exchanges.
Article 26 Laboratories shall strengthen the protection of intellectual property rights. The research results of the monographs, thesis, software, and databases completed by the laboratory shall be subject to the name of the laboratory. Patent applications, transfer of technological achievements, and reporting rewards shall be handled in accordance with relevant state regulations.
Article 27 The laboratory director's fund shall be listed in the operating subsidy and shall be managed by the laboratory director. It shall be mainly used to support topics with innovative ideas, the initiation of new research directions and the cultivation of outstanding young talents. Under the premise of complying with relevant national policies, laboratory funds can be used for job subsidies and performance awards.
Article 28 Laboratories shall establish and improve internal rules and regulations, attach importance to and strengthen management. Focus on the construction and use efficiency of instrumentation and computer networks. It is necessary to attach importance to the construction of academic style and the construction of scientific ethics, and to strengthen the scientific and authenticity review and preservation of data, materials and achievements.
Chapter VI Assessment and Evaluation Article 29 The supporting unit shall conduct an annual assessment of the laboratory work every year, and the results of the assessment shall be reported to the competent department for the record.
Article 30 On the basis of the annual assessment, the Ministry of Science and Technology regularly organizes laboratory cycle assessments, and the evaluation commissions intermediaries in accordance with different fields, in the spirit of “openness, fairness, and impartiality” and adherence to “reliance on experts, promotion of democracy, seeking truth from facts, and impartiality. Article 31 According to the principle of survival of the fittest, the department (local) laboratory that is assessed as excellent, in line with the overall planning of the laboratory, may apply to upgrade to a national key laboratory. National key laboratories with poor performance and non-compliance shall be downgraded or eliminated.
Chapter VII Supplementary Provisions Article 32 The laboratory shall be uniformly named as “××National Key Laboratory (Relying Unit)” and the English name shall be “State Key Laboratory of ×× (Relying Unit)”. Such as: State Key Laboratory of Tribology (Tsinghua University), State Key Laboratory of Tribology (Tsinghua University).
Article 33 The methods for the management of laboratory funds shall be separately promulgated.
Article 34 Departments (industry, local) laboratories are an important part of China's laboratory system, and their management methods may be formulated by themselves in accordance with these Measures. Without the support unit of the administrative department, the management work may be strengthened by referring to these measures.
Article 35 The Ministry of Science and Technology is responsible for the interpretation of these Measures.
Article 36 These Measures shall come into force as of the date of promulgation.
